Indian investors can use funds from property sales, business income, gifts from family members, inheritance, or accumulated savings. All sources must be documented with bank statements, tax returns, property documents, and other legal documentation to demonstrate lawful origin.

H-1B holders can file I-526E and I-485 concurrently while maintaining their current status. If job loss occurs after filing, they can remain in the U.S. legally during processing. The Employment Authorization Document (EAD), typically received within 2-6 months, provides work authorization independent of any specific employer, while Advance Parole (AP) permits travel outside and re-entry into the country during processing.

A spouse and unmarried children under 21 at the time of filing are automatically included as derivative beneficiaries. They receive the same immigration benefits, including work authorization and eventual Permanent Residence, without any separate investment requirement.

EB-5 Projects are evaluated on both immigration compliance and financial soundness. From an immigration standpoint, investors should verify that the Project qualifies under a valid TEA category (Rural, High-Unemployment, or Infrastructure) and that its economic impact analysis credibly supports the creation of at least ten full-time U.S. jobs per investor. The credibility of the economist and the job-creation methodology are critical, since weak or inflated projections can create problems at the I-829 stage when results must be proven. On the financial side, due diligence is key. Investors should assess the developer’s experience, capital structure, sponsor equity, market demand, and exit strategy. EB-5 Projects with permits, construction progress, and committed third-party financing generally carry lower risk. Understanding where EB-5 capital sits in the capital stack - ideally in a senior or secured position - provides insight into repayment safety.

Most Indian EB-5 investors choose Regional Center EB-5 Projects because they provide greater flexibility, pooled capital, and reduced personal job-creation risk. These Projects are managed by USCIS-approved Regional Centers that can count direct, indirect, and induced jobs through economic modeling, so the investor’s job requirement is met based on total Project spending and impact, not on maintaining a fixed number of employees.

In contrast, Direct EB-5 Projects require each investor to prove the creation of ten full-time, permanent U.S. jobs within their own enterprise, which is harder to document and sustain. Since the 2022 Reform and Integrity Act now prohibits multiple investors from pooling into a single Direct offering, Regional Center Projects remain the most practical and reliable route for Indian investors seeking both immigration success and Project stability.
