EB5 United has commissioned an in-depth analysis of the average processing times for I-526E petitions following the implementation of the EB-5 Reform and Integrity Act of 2022 (“RIA”). Since petitions began being filed in August and September of 2022, we have gained valuable insights into the efficiency of these approvals. Prior to the RIA, most investors received I-526 approval within 2-4 years. The RIA aimed for USCIS to approve petitions within 240 days (120 days for Rural TEA projects), speeding up the process. Now, two years post-RIA, we can assess USCIS’s performance. While the 240-day target has not been met industry-wide, rural project processing has significantly improved since the RIA.

EB5 United has sponsored three Rural TEA projects and one High Unemployment (HUA) project since 2022.  Since the RIA, our Rural TEA projects have seen average processing times of 7.8, 8.7, and 10.5 months respectively, with over 68% of investors in Rural Project C receiving approval to date. Our HUA project has only seen one I-526E approval, which was filed September 27, 2022 and approved October 22, 2024 (25 months). This data underscores the effectiveness of Rural Priority Processing.

With nearly two-thirds of Rural Project C’s petitions adjudicated, we believe this offers the clearest insight into expected processing times. The data shows an average processing time of 12.2 months for petitions filed before I-956F approval and just 5 months for those filed afterwards. The project received I-956F approval in July 2023.

Recently, additional adjudication data was released by IIUSA representing eleven of our competing Regional Centers. This showed data for 1,254 I-526E petitions filed, 436 rural petitions and 815 HUA petitions. This data suggests average Rural TEA approvals at 10 months and HUA approvals at 14 months. However, of all the petitions in this data pool 49.3% of these rural filings have been adjudicated whereas only 15.7% of HUA these filings have been adjudicated. This means 84.3% of HUA filing are yet to be adjudicated.

Additionally, the IIUSA data also showed 71% of outstanding HUA petitions have been pending greater than 14 months while 70% of outstanding rural petitions have been pending less than 10 months. Given the low adjudication rates and the length outstanding on unadjudicated HUA petitions, we anticipate that HUA TEA projects will see average processing times rise significantly above 14 months once the other 84.3% of these petitions are adjudicated.

We are also pleased to announce that our investors have been receiving I-485 Adjustments of Status in an average of 5.3 months post-I-526E Approval. To date, all our investors that have obtained a Green Card post RIA have received their Green Card within 18 months of filing their I-526E Petition. Seven of our investors have received their Green Card within 1 year of filing an I-526E petition, and our quickest Green Card issued was exactly 4 months from the date of filing.
