Limited Time to Invest at $500,000

EB-5 Investment Amount returns to $500,000 – down from $900,000

The EB-5 Regulations imposed on November 21st, 2019 have been deemed unenforceable as a result of the lawsuit Behring vs San Francisco. EB-5 Investors now have until June 30th to invest once again at the $500,000 TEA requirement. Congress has set June 30th, 2021 as the sunset date for the EB-5 program and there’s a possibility that the minimum investment price point would return to $900,000 at that time through a legislative action. However, it is possible that the EB-5 program will be extended to the end of the fiscal year on September 30th.

This investment price reduction comes as a surprise to many in the industry and likely provides EB-5 investors a short window of opportunity to invest at $500,000. It is presently our understanding that the effects of the lawsuit will not impact the adjudications of $900,000 investments.
