In a groundbreaking shift within the Reform and Integrity Act of 2022 (RIA), US-based EB-5 investors were granted the ability to concurrently file their Adjustment of Status applications alongside their EB-5 Petitions. This pivotal change allows investors to swiftly access the core privileges of a Green Card, including the freedom to work, reside, and travel both within and outside the US while awaiting their EB-5 Green Card Approval.

Initially, investors were securing Employment Authorization Documents (EADs) in approximately 3-4 months and Advanced Parole (AP) Travel Permits within 7-9 months. However, this advantage is now being expedited and extended for a longer duration.

In the fall of 2023, USCIS expanded the maximum validity period of EADs from 2 to 5 years. This significant enhancement empowers EB-5 Investors filing from within the US to work freely in the United States without concerns about their EAD expiring before receiving their US Green Card. Furthermore, we have received numerous reports from attorneys indicating that recent investors who concurrently filed their Change of Status applications with their I-526E Petitions are receiving joint EAD and AP issuance within a mere 2-3 months of filing.
